Welcome to ExperiencesHK and Camptopia Sheung Shui! We create premium, seamless outdoor events. By confirming your booking, paying an initial project deposit, or accepting our quotation, you (the Client, Organiser, or Guest) agree to these terms. Let’s make your experience unforgettable—and safely covered.

1. The Core Deal: Scope & The “Project Milestone” System

1.1 Nature of Use: Any booking or space allocation with us constitutes a personal, revocable licence to occupy a venue for a specified time period. It is not a tenancy, lease, or real estate interest. We retain full, general possession and management control at all times.

1.2 The 30-Day Project Lock-In: For large-scale events (including University Orientation Camps, Corporate Retreats, and Weddings), your initial website transaction pays for a secure calendar hold.

1.3 Fully Refundable Window: If a customized, final Event Summary (Schedule 1) or detailed Project Scope is not mutually executed in writing within 30 days of your online transaction, your deposit is 100% refundable.

1.4 Credit to Final Total: Once the final contract or project package is approved, your entire online deposit is automatically credited toward your grand experience/event total.

2. Signing Authority: Accountability Setup

We love working with student groups, universities, and corporate committees. However, to ensure an agreement is binding under Hong Kong law, we require clear accountability:

2.1 Double Sign-Off for Student Groups: If you are booking an Orientation Camp (“O-Camp”) or student society event, the agreement must be executed by both:

  • The current, active President/Chairperson of the student society (signing in their personal and representative capacity).
  • An authorized representative of the university’s Student Affairs Office (SAO) or equivalent official administration.

2.2 Individual Accountability: If a student society leader executes a booking without official university administration co-signatures, that signing individual accepts joint and several personal liability for all fees, property damages, or legal indemnities arising from the event.

3. Food, Drinks, and Vetting (The F&B Disclaimer)

3.1 Procurement Agent Status: ExperiencesHK operates exclusively as a professional procurement agent. We do not hold municipal catering, food factory, or liquor licenses.

3.2 Sourcing Service Fee: When you request food, beverages, or specific equipment, our MCIPS-certified procurement lead personally sources, vets, and bulk-buys from trusted, third-party licensed providers. We pass the wholesale cost directly to you, itemized with a standard 20% sourcing service fee.

3.3 Third-Party Liability: Because all catering and alcohol are provided by external vendors or bulk-purchased from licensed distributors on your behalf, the Client assumes all ultimate liability associated with consumption. ExperiencesHK explicitly disclaims liability for foodborne illnesses, supply issues, or unapproved alcohol distribution.

3.4 Bring Your Own Vendor (BYO): If you opt to bring your own caterers or bar services, you guarantee that they are fully licensed under Hong Kong law. We reserve the contractual right to demand proof of municipal licensing and a signed vendor indemnity waiver at any point prior to venue entry.

4. Noise, Headcounts, and Playing by the Rules

4.1 The Hard Stop at 22:00: All music, amplification, and loud microphones must cease completely by 22:00 (10:00 PM). No exceptions. Volume levels and speaker positioning are at the sole discretion of our on-site team.

4.2 Strict Headcount Limits: Our absolute maximum site capacity is 110 persons (including children). If your group exceeds this cap, we reserve the right to deny entry to excess guests or assess an immediate charge of HK$175 per extra person.

4.3 Minor Supervision: For school or youth events, a strict supervision ratio of at least 1 responsible adult per 20 minors must be actively maintained on-site at all times.

5. Cancellations, Weather, and Disruption

Once your 30-day “Project Lock-In” window has passed and a final agreement is executed, the following cancellation tier applies to the baseline Venue Licence Fee:

5.1 Bad Weather Protocol: If a Typhoon Signal No. 8 or above or a Black Rainstorm Warning is officially hoisted by the Hong Kong Observatory within 3 hours of your event start time or during the experience, the event will be safely paused or postponed. You are entitled to one free date change to a mutually available date within six (6) months. T1, T3, Amber, or Red warnings proceed as scheduled unless flagged as dangerous.

6. Legal Protections & Liability Caps

6.1 Limitation of Liability: To the maximum extent permitted under Hong Kong law, our total aggregate liability for any claim arising out of your booking is strictly capped at the total amount paid to us under your agreement. We are explicitly not liable for any indirect, consequential, or business interruption losses. Nothing limits liability for death or injury resulting from negligence.

6.2 Comprehensive Indemnity: The Client agrees to fully indemnify Experiences Hong Kong Limited, Camptopia Limited, and our underlying Landlord against all claims, fines, legal penalties, or property damages caused by the acts, omissions, or vendor choices of the Client and their guests.

6.3 Third-Party Rights (Cap. 623): Pursuant to the Contracts (Rights of Third Parties) Ordinance (Cap. 623) of Hong Kong, our affiliated companies (including Camptopia Limited), our landlords, and our staff have the express right to directly rely upon and enforce the limitations of liability, indemnities, and rules contained in these terms.

6.4 Governing Law: These terms are governed exclusively by the laws of the Hong Kong SAR, and any formal legal disputes will be handled exclusively by the courts of Hong Kong.
